Food
Selling Requirements: County of San Diego

- No food preparation nor handling any open foods
is allowed at a swap meet stand and is restricted
to permanent facilities. (This includes no open
samples). No food prepared or stored in a private
home shall be offered for sale or given away.
- Produce may be sold on stands in association
with a vehicle under permit and with a sticker,
or as a concession stand (see #10).
- Vehicles that are used shall operate from a
headquarters with a valid Health Permit. All food
shall be stored at the headquarters when vehicle
is not in operation.
- Vehicle requirements:
a. Current Health Permit stickers (permit) that
are permanently affixed are required on all vehicles
used to sell food, including produce.
b. Signs shall be permanently fixed on both sides
of vehicle showing the business name (with 3"
high x 3/8" thick letters), headquarters address
and phone number (in 1" minimum letters). Magnetic
signs are acceptable.
c. Food products shall be stored or displayed
at least 12" above the pavement and protected
overhead with a cover over entire display. (Minimum
canvas required).
d. Refuse containers are required and are the
vendors' responsibility.
- 100% pre-packaged, non-perishable foods may
be sold from vehicles with the same requirements
as above or at a permanent concession stand (see
#10).
- Pre-packaged, perishable foods may be sold from
approved vehicles and shall be maintained at temperatures
below 45ŒF.
a. Dry ice may be used for frozen food refrigeration.
b. Mechanical refrigeration is required to maintain
the proper temperature for perishable non-frozen
foods. The unit must operate from a power source
on vehicle but may be plugged into power source
at swap meet site. "Prevention Comes First"
- All pre-packaged food shall be properly labeled
and obtained from an approved food facility.
- Mobile Food Preparation Units (hot food trucks)
may operate at swap meets:
a. The vehicle shall have a valid Health Permit
and sticker that has been issued to the operator
of the vehicle.
b. Mobile Food Preparation Units shall return
to headquarters daily for servicing. Stationary
mobile food units may be approved as permanent
establishments provided that they are connected
to sewer, water and electricity. Connections shall
meet building department requirements.
c. Toilet facilities shall be located within 200
feet of the mobile food preparation unit. d. Outside
barbecues are permitted in conjunction with permanent
food facilities or Mobile Food Preparation Vehicles
only.
- Food vending vehicles (packaged lunch trucks)
and Push carts may operate at swap meets. These
types of vehicles shall meet all requirements
and have valid Health Permits and stickers permanently
affixed on appropriate location on each unit.
- Operators may apply for a Health Permit to sell
pre-packaged food from a booth and shall be classified
as a concession stand.
a. The food display requirements are the same
as that for a vehicle except that no vehicle is
required.
b. An approved headquarters is required for storage
of food when not at the swap meet. A letter of
agreement (headquarters letter) and a copy of
the headquarters permit issued by a recognized
health department (for wholesale or out of county
facilities) shall be submitted with the Health
Permit application.
c. The Health Permit shall only be valid at the
location specified in the permit.
- All of the above stated requirements shall also
apply to non-certified farmers selling food products
at Certified Farmers Markets.
- In the City of San Diego, a Health Permit is
required for the sale of birds at swap meets.
